ILLEGAL DETENTION: RELEASE OUR CHAIRMAN; EMPLOYEES OF CAPITAL OIL AND GAS CRIES OUT TO FEDERAL GOVERNMENT AND DSS.

Employees of Capital Oil and Gas Industries Ltd have urged the Federal Government to release their Chairman, Dr Ifeanyi Ubah, who is in the Department of State Services (DSS) custody. The workers urged Acting President  Yemi Osinbajo, Senate President Bukola Saraki, House of Representatives Speaker Yakubu Dogara and the Minister of Labour, Sen. Dr Ifeanyi Ubah Saga: United Labour Congress Appeals To Federal Government To Embrace Dialogue

The United Labour Congress (ULC) has appealed to the Federal Government to embrace dialogue in resolving the face-off between the management of Capital Oil and Gas and Department of State Services (DSS). The face-off is over alleged illegal sale of petroleum products. Alhaji Tokunbo Korodo, the Chairman of Lagos State Council of the union, made the appeal in a statement in Lagos on Friday. Korodo said that the products in question were stored in the company’s tank farm by Nigerian National Petroleum Corporation (NNPC). Fayose condemns continuous detention of Ifeanyi Ubah, slams DSS over illegal detention

The Ekiti State Governor, Ayodele Fayose, has called for the immediate release of the Chief Executive Officer of Capital Oil and Gas Ltd, Ifeanyi Ubah, who has been in the custody of the Department of State Services since May 5, 2017. He is being accused of diverting N11bn being the sum realised from the sales of petroleum products stored in his facility by the Nigerian National Petroleum Corporation but Ubah's group is also accusing NNPC of N16b debt. A Federal Capital Territory High Court sitting in Jabi, on Thursday, had granted the DSS the nod to hold Ubah, for another 14 days. Justice Yusuf Halilu extended the detention order following an ex-parte application the DSS filed through its lawyer, Mr. G.O.A. Agbadua. Justice Mohammed Idris of the Federal High Court sitting in Lagos on Thursday ordered the unconditional release of the Chief Executive Officer of Capital Oil Limited, Dr. Patrick Ifeanyi Ubah, from the Department of State Services (DSS) custody. Despite heavy downpour in Federal High Court, Lagos, patriotic Nigerians and workers of Capital Oil and Gas who had earlier registered their displeasure at the impasse as over 2,000 workers under the payroll of Capital Oil and Gas have been rendered jobless defied the rain by trooping out en masse to show support for Dr. Ubah. ILLEGAL DETENTION: COURT ORDERS DSS TO RELEASE IFEANYI UBAH UNCONDITIONALLY WITHIN 48 HOURS

A Federal High Court sitting in Lagos, Thursday morning has ordered the Department of State Service, DSS, to within 48 hours release Managing Director of Capital Oil and Gas, Dr Ifeanyi Ubah who has been detained illegaly since the 5th of May, 2017. Despite heavy down pour in court today, patriotic Nigerians defied the rain and trouped out en masse show support for Dr. Ubah. Trial judge, Justice Mohammed in a 100 page judgment, ordered the DSS to release Dr. Ubah, if it fails to file a charge against him within the next 48hours. Ubah was arrested by DSS over an alleged oil deal with the Nigerian National Petroleum Corporation, NNPC. The court also berated the DSS for lying to the court that Ubah was arrested in Abuja, while from every available evidence, he was arrested in Lagos and flown to Abuja, where he has been detained some weeks.

1. There is what is known as "Throughput contents" in the contract document between NNPC and Capital Oil . The "Throughput" agreement, in accordance with the norms and practice in the industry worldwide, allow conversion and diversion of its products by the ‘Operator’ so long as the Operator is prepared to re-deliver the products (in terms of the current contract) within 7 days of demand by the products owner or to pay a penalty for non re-delivery. The penalty to re-deliver is expressly stated by the Contract to be a mere breach of contract remediable by the payment of penalty to the owner. The penalty is comprised of the cost of delivery of the products to the Operator’s tank farm with interest at 1%. The Ohanaeze Youth Council (OYC) has vowed to storm the High Court with 100 lawyers in solidarity with Ubah on May 18 when he is expected to be arraigned by the DSS.

The South East youth group condemned his continued detention by DSS over a business dispute with the NNPC, describing it as an affront on Ndigbo. The National President of OYC, Mazi Okechukwu Isiguzoro, in an interview vowed to mobilize Igbo youths to show solidarity with Ubah during the planned court session in Lagos. Isiguzoro urged Igbo youths to troop out to Enugu en mass for onward movement to Lagos on May 17. Anger and moral indignation swelled further yesterday over the continued detention of businessman, Dr Patrick Ifeanyi Ubah, by the security  services. The Department of State Services (DSS) Friday failed to produce Managing Director of Capital Oil and Gas Limited, Ifeanyi Ubah, as ordered by Justice Mohammed Idris of the Federal High Court in Lagos. The DSS instead filed a preliminary objection challenging the court’s jurisdiction to entertain Ubah’s suit. Mr Peter Oluremodu, counsel to the DSS said Ubah was not produced because there was an order to detain him for 14 days issued by a Federal Capital Territory High Court. COURT ORDERS DSS TO PRODUCE UBAH

The Nigerian National Petroleum Corporation, NNPC, and Capital Oil and Gas Industries Limited have disagreed over alleged N11 billion petroleum products theft. Capital Oil launched an accusation against the NNPC, when it alleged that the corporation had over N16 billion outstanding debts to settle. But the Group General Manager, Group Public Affairs Division of the NNPC, Mr. Ndu Ughamadu, disclosed in a telephone interview that Capital Oil’s narrative was a distraction from the main issue.
